To use land line, person should be at one place where that phone is installed. But mobile phones remove this barrier by allowing customers to communicate with each others from any place where it has signals. AS this system is connected with the satellite, person can communicate without any hurdle. This is the only technology on the globe which is sold at highest numbers than any other technology. Out of 6.8 billion people on the earth, 5 billion use mobile phones (international telecommunication union, 2010).Two countries Pakistan and UK have been chosen for this dissertation because these two countries are very much different in many prospective. Pakistan telecommunication authority (PTA, 2010) shows that mobile phone in Pakistan enjoy a tremendous annual growth of 119% during 2000 to 2007. It is also being observed that between fiscal year 2006-07, mobile phone penetration increased by 15.5%. Whereas between years 2007-08, it was 55.6% which is 34.9% higher than Indias for the same period. Pakistans telecommunications industry maintains its growth trend in the coming years as well with the penetration rate in 2009 was 61.8% and in September this penetration rate reaches to 70%.On the other hand UK mobile phone market is different than Pakistani market. According to report presented by Ofcom (2007), the mobile phone market in UK grew by 41.3% between 2003 to 2007.In 2010, the penetration rate in UK was 84% which stay same till 2011.Mobile phone market is very competitive these days as there are number of companies who are trying to compete in this market to become the best in the business. It is very essential for the companies to better understand the buying behaviour of the customers.It gives them an edge on the competitors in targeting the right segment and getting market share. The purchasing decisions of consumers are mostly affected by factors that have direct or indirect impact on how we live and what we consume. Culture is one of the factors that impact on buying behaviour of consumers. Culture represents the behaviour, beliefs and, in many cases, the way we act learned by interacting or observing other members of society. In this way much of what we do is shared behaviour, passed along from one member of society to another. Culture play an important role in breaking target market into different segments and then targets the right segment. Blackwell et al., (2001) demonstrated that culture has a profound influence on how and why consumers purchase a range of products and services. The selection of products by consumer affect by the culture and it can help companies to design their marketing plan. Culture shapes the lifestyle of the consumer which affect directly on the buying pattern of the consumer. The cultural comparison between Pakistan and UK about mobile phone purchasing behaviour will provide a complete picture which will help understand these two countries mobile phone market. Culture is defined as ways of life like language, arts science, thoughts, spirituality, social activity and interaction (Roshan).By Hofstede (1991, 2001), culture is an identity that is used to distinguish one group from another.Keegan and schlegemilch (2001) state that culture is formed by people those are living in a community for many years and has a life that pass on from one generation to another. This mean that culture has a starting point and finish point. So its all about the life style of a group of people whom code of life is represented by culture.Doney etal(1998) defined culture as a system of values and norms that are shared among a group of people and that when taken together constitute a design for living. So by Doney culture is the design of life. There are many different cultures exist and these cultures represents particular group of people who actually adapted that design. It also depend on the individuals whose life style effect on the culture.Doney Lowe (2008, 73) believe that culture is made up of three essentials components. Those are (1) Beliefs: refers to the mental and verbal processes that reflect peoples knowledge and assessments of things. (2) Values: used by people as guide for what is appropriate behaviour. (3) Customs: Overt modes of behaviour that constitute culturally approved or acceptable way of behaving in specific situations. To be very precise as far as this project is concerned, above definitions of culture are generalised. Actually theme of culture that is more suitable to this dissertation is that culture defined way of living, behaving, acting in a particular situation, dealing with others and organising oneself. That is way it is very important for the marketers who are dealing international business particularly should understand the importance of this phenomena. If they understand this concept and then target particularly segment on the basis of culture then it will be easy for them to launch the product in the right segment. So culture is the medium for communication for marketers that transmit these beliefs, values, behaviour and norms into shaping the attitude and behaviour of human. It help the members of such group in deciding what, why, where, how and when to do different things and how to act in a particular situation. So it means that culture is not a static concept. Its dynamic and it can change with the passage of time and influence ones own behaviour although they also contribute to the culture. So consumer buying behaviour is the procedure which shows what, how, when and where people buy the product as they do. Thus this is an attempt to understand the decision making process in buying the products. The first thing is trying to understand the buying behaviour of the individual from the same group. Then generalise it to the whole group because all the individuals in the group have same characteristics. But decision making process is not easy. Th ere are different levels of decision making forms. Some are low-involvement decision making process , some are high involvement decision making process. So it all depends on the product itself as well. Mobile phones are not high involvement decisions making products. But these decisions are also depend on consumer perception, attitudes and understanding of the given product based on the educational background, societal background, financial situation and more importantly social and cultural environment. Culture here play an important role on the consumer buying pattern as individuals can not live alone. They are part on culture and the way they behave all depend on the cultural environment in which they live. So it is very important that to understand the cultural to study the buying behaviour of consumer and this dissertation is all about this. Pakistan and UK are two different cultures. Both these cultures have strong influence on the buying behaviour of its consumers. Hofstede (1991, 2001) divide culture into two different types. One is called individualistic and other one is collectivist. According to this dissertation UK is highly individualistic country in which people mostly decide individually about the buying of products. On the other hand, Pakistan scores highly as a collectivists country where family, friends or group influence the buying behaviour. Individualist and collectivist are two out of five cultural dimensions which Hofstede find out when he was trying to find an explanation for the motivation of IBM employees around the world. Hall (1960, 1981, 1990) presented culture as high and low context cultures. He explains that culture can be divided into two groups. One is called high context culture and other one is called low context culture. The theme of difference between these two cultures according to Hall is the individual relationship. He stated that high context culture is based on the close tie between individuals personals relationships such as family, friends and colleagues etc. and in this group information and knowledge is share exclusively. People in this group are social and they care each other, listen to each others, sometime depend each others and discuss information between each others. Hall (1960. 1981, 1990) stated that high context culture is more common in East. And as far as this project is concerned, it represents Pakistan. On the other hand, low context culture is belonging to outer group. In this culture, people live their individual life. They belong to their personal network. Family, f riends and colleagues are all separate to each others. All of them live their individual life. Things are share less exclusively. People are more independent and make their own decisions.UK is the one in this dissertation which represents low context culture. Here society in not social enough to influence the decisions of others. People live their own life and they rarely involve in the decisions making process of others. Industry Background Telecommunication industry is the fastest growing industry in the world. This is because of the fast growth in technology sector and increasingly becoming part of human lifestyle. With 73% of the world population is using mobile phones , the network covers the 90% of the world area (mob thinking, Oct2010).Mobile phone industry started way back in 1970s when first mobile phone launched in Japan.After that this industry never look back and continuously grow with different transition period. During the last 40 years it have undergone a transition from technology focused for professional business to a mass consumer market and become an integral part of lifestyle. With the passage of time, it is not only used as a communication tool but also it is helping consumers in other businesses like of internet , financial transaction , tracking device , video conferencing and many more. Pakistan and UK mobile phone market is very strong in the sense that Pakistani market is still growing and it need to know more about consumer buying behaviour.UK mobile phone market is also growing but more effort is needed to do business with the existing customers. Culture of an important role in consumer buying behaviour in both these market which is why this research is being done to let marketers understand the depth in the market. Gustave Courbet's Reclining Nude In the Philadelphia Museum of Art are five paintings by Gustave Courbet; of all of these I found Reclining Nude (1868, Oil on canvas, The Louis & Stern Collection, 63-81-20) the most interesting. It depicts a nude woman lying on the beach beneath a billowing canopy. A dark, but tranquil sea is in the background. The sky is dark as if the final rays of the sun were disappearing over the horizon. There are a few clouds in the sky, they are dark but not threatening. The picture is very dark in general and there is no obvious light source. The edges of the painting are so dark it is impossible to tell what the nude reclines against. A very dim light falls on the woman, who lies on her right side. The upper half of her torso is twisted to her left and her hips and legs face the viewer. Her right leg is bent slightly so her calf is beneath her straightened left leg. The woman is not as thin as classical nudes, her hips are somewhat broad and her thighs are slightly heavy. Her arms are crossed languidly over her head. Because her arms are crossed over her head, her face is almost completely in the shadows; this shadowing covers the detail of her face in such a way that she could be almost anyone. She gazes wistfully at the ground to her left. The woman is rendered very softly and is in a very sensuous pose. This picture would have been found scandalous for its sexual overtones as was Courbet's La Demoiselles au bord de la Seine. A scarlet cloth lies in front of her; it has a very rumpled look which has sexual implications. The vacant, wistful look and the languid crossing of her arms suggests that she is thinking of a lover who has just left her. The car... ...f vision one is more able to appreciate Courbet's careful attention to the curves and anatomy of the woman's body, as well as his eye for small detail such as the two tiny boats on the horizon. While many critics of Courbet's time could not understand his choice of subject matter, they could appreciate his execution of the subject matter. Gustave Courbet's subject matter may not have been understood or considered proper in his day, but now they are considered to be more acceptable. One, whether of the past or present, must appreciate his technical abilities; his mastery of line, form, and balance. Though his lack of color is disappointing, the picture in itself is very pleasing to look at because it is such a tran- quil, restful scene. While Courbet was not totally appreciated in his day, he is in these times considered to be an excellent artist. The Crucible by Arthur Miller The Crucible is a fictional retelling of events in American history surrounding the Salem witch trials of the seventeenth century, yet is as much a product of the time in which Arthur Miller wrote it, the early 1950s, as it is description of Puritan society. At that particular time in the 1950s, when Arthur Miller wrote the play the American Senator McCarthy who chaired the ââ¬ËHouse Un-American Activities Committeeââ¬â¢ was very conscious of communism and feared its influence in America. It stopped authorsââ¬â¢ writings being published in fear of them being socialist sympathisers. Miller was fascinated by the Salem Witch Trials and that human beings were capable of such madness. In the 1950s the audience would have seen the play as a parallel between the McCarthy trials and the Salem Trials. A 21st century audience would look at the play from the perspective of needless hysteria and accusations and would be amazed that human nature when put into these situations reacts the way it does in the play. In modern time we are able to appreciate the play without being concerned with the parallels of McCarthyism. Although my selected scene is only three-quarters way through the play it is very conclusive in the way that it shows the ability of the court to accept the condemnations of people looking for vengeance and the girlsââ¬â¢ lies throughout the trials. The historical background to the play, although quite old still relates to human life and behaviour. It shows the willingness of human beings to blame anyone but themselves. It enforces the belief that humans are not ready to take responsibility for their actions and would rather find a scapegoat than be righteous. The key scene i... ...willing to do to get her way. Only the girls, Mary and Proctor know to what extent Abigail can manipulate a situation in her favour as well as people. Even when she appeals for help from Danforth they continue to echo her. E.g. Mary: ââ¬Å"Mr. Danforth!â⬠Abigail and the girls: ââ¬Å"Mr. Danforth!â⬠This may be because Abigail does not want Mary to tell Danforth the truth and Abigailââ¬â¢s plot. This therefore prevents Danforth from finding out about Abigail and her manipulation of the other girls. Mary has to show great willpower to oppose Abigail; e.g. ââ¬Å"I have no power.â⬠In the stage directions it shows Mary summoning all her determination from within to stand up to Abigail. In this scene we can see how powerful Millerââ¬â¢s characters can be. Our first impression of Abigail is accurate because she is clearly capable of sending people to death to save herself.

1. Risk taking is acceptable to management: a. Management must recognize the risk/reward relationship and find organizational mechanisms for handling it. And it must communicate a clear understanding that reasonable risks are acceptable, since they are the handmaidens of progress. On the innovative front, two methods are available for dealing with risk: diversification and cheap failures. They can and should be used in concert. i. Diversification- allows companies to spread risk over many rolls of the dice, as opposed to betting the company on a single roll. Because one can never know in advance which ideas will be winners and which will be losers, having a diversified ââ¬Å"portfolioâ⬠of ideas in play makes sense. ii. Cheap Failures- project or experiment that is terminated with the least possible outlay of resourcesââ¬âjust enough to tell managers that ââ¬Å"This isnââ¬â¢t going to work.â⬠They back promising ideas with small budgets and look for ways to test th em with the least input of resources. Like card players, they quickly fold when they recognize that they have a weak hand. Conversely, they increase backing for strong ideas. 2. New ideas and new ways of doing things are welcomed b. The worst environment for creativity is one that is unwelcoming to new ideas. ââ¬Å"Weââ¬â¢ve been successful over the years by doing things this way, so why should we change?â⬠An organization with this attitude is heading for trouble. In fairness, management is compelled to shoot down good ideas when (1) those ideas lack a strategic fit with the business, or (2) the organization lacks the resources to pursue them. In these cases, how- ever, management has a responsibility to communicate its reasoning to employees. Beyond welcoming new ideas, the organization should view innovation as a normal part of businessââ¬ânot a special activity practiced by a handful of employees. 3. Information is free flowing c. Information can stimulate thinking, which leads to idea generation. Many creative ideas are formed at the intersection of different lines of thought or technology. When people communicate and share information, they get ideas that havenââ¬â¢t been considered yet. In hierarchical firms, information is often hoarded as a source of organizational power. Information flows are controlled and channeled through the chain of command. People must demonstrate a ââ¬Å"need to knowâ⬠to have access to certain information. This control impedes the catalytic function of communication and limits opportunities for different pieces of information to intersect and combine in peopleââ¬â¢s minds. Managers can encourage the free flow of information in many ways: through e-mail, the physical co-location of team members, joint work sessions, and regular brown-bag lunches. 4. Employees have access to knowledge sources d. Knowledge is often the raw material of creative thought. Some companies have developed elaborate knowledge management systems to capture knowledge, store it, and make it easily avail- able for reuse. These systems help ensure that what was learned by someone in Unit A doesnââ¬â¢t have to be learned anew by someone in Unit B. iii. Another way to help employees tap sources of internal knowledge is through the creation of communities of interest. A community of interest is an informal group whose members share an interest in some technology or application. Whatever the interest may be, newsletters and periodic meetings held by these communities provide opportunities to share knowledge and spark the imagination. iv. External knowledge is equally important as a stimulant to innovation. External knowledge invigorates and adds vitality to organizations. Organizations need people in high places who will champion good ideas and provide them with moral support and protection as they travel the bumpy road toward commercialization. Although executive patronage is often necessary for radical innovation, such support is not always well directed. Senior executives are not necessarily more clairvoyant than other managers, and they sometimes place their bets on the wrong ponies. Physical surroundings can also have an impact on creativity. Like the organizational environment, the physical environment can be engineered in ways that encourage higher creative output. For example, when an environment is filled with many types of stimuli and when it provides physical and electronic links between individuals, it encourages people to see new connections and to think more broadly. Workspace design and work effectiveness are linked. b. Organizational researchers have known for a long time that the frequency of communication between co-workers decreases dramatically as the physical distance between them increases. Bail Application Larceny
This matter is an application for conditional bail your honour. Mrs. Ayoub is a 51 year old divorced woman that lives on her own and has been charged with larceny under section 117, common assault under section 61 and resisting arrest, under section 58 of the Crimes Act 1900. Your honour, I submit my client has neither presumption in favour or against bail as she doesnââ¬â¢t fall under sections 8 to 9. Therefore Mrs. Ayoub has no presumption for bail however, under section 13 of the Bail Act, my client is still eligible for bail despite having no entitlement, therefore I plead for bail to be considered granted to my client.Has your honour been made aware of the facts of the case? * The alleged incident took place after a substantial amount of alcohol had been consumed, putting my client in a different state of mind. * It was not Mrs. Ayoubââ¬â¢s intention to steal the radio as she placed it in her shopping bag and was then distracted by a conversation. She then walked out of My er forgetting to pay for the radio which is when she was confronted by the security guard causing her to panic and push him away. * As a result of this, police arrived and Mrs. Ayoub was in a state of distress and the police struggled to escort her to the police vehicle till she calmed down.Your honour, the criteria to be considered in Mrs. Ayoubââ¬â¢s case regarding section 32 1) a) states ââ¬Å"the probability of whether or not the person will appear inà courtà in respect of theà offenceà for whichà bailà is being considered, having regard only toâ⬠: Subsection i. ââ¬Å"the personââ¬â¢s background and community ties, as indicated by the history and details of the personââ¬â¢s residence,à employmentà and family situations and the personââ¬â¢s prior criminal recordâ⬠Your honour, my client was left by her husband many years ago and as a fifty one year old woman, resulted in psychological distress leading her to psychiatric help while he lives in America.She has no sureties or property as her only form of income is her pension cheque. She has no other immediate family in Sydney and resides at a unit in Parramatta but my clientââ¬â¢s daughter keeps in contact with her mother and is willing to let Mrs. Ayoub reside with her in Melbourne. Due to this arrangement, my client will not breach such ties with her daughter by not appearing in court on set dates as it could strain the relationship with both parties. My client does have a criminal history over twenty years with ninety convictions of arceny, mainly shoplifting, however, none of the convictions consisted of assault or resisting arrest. Section 32 1) a) subsection ii. states ââ¬Å"any previous failure to appear inà courtà pursuant to aà bail undertakingà or pursuant to a recognizance ofà bailà entered into before the commencement of this sectionâ⬠Your honour, my client has never failed to appear in court even though she has a medical certificate fr om her previous psychiatrist stating that she had a nervous breakdown when her husband left her.Section 32 1) a) subsection ii. reads ââ¬Å"the circumstances of theà offenceà (including its nature and seriousness), the strength of the evidence against the person and the severity of the penalty or probable penaltyâ⬠Your honour, my clientââ¬â¢s offence of assault and resisting arrest were as a result of the alleged larceny as she had no intention to steal the radio, there is no evidence to prove that my clientââ¬â¢s intention was to permanently deprive the owner of that property.The mental element of committing the crime is not present as my client was in severe distress when she had forgotten that it was still in her bag. Mrs. Ayoub was taken by surprise when the guard approached her and didnââ¬â¢t intend any harm towards him when she pushed him away as she panicked. When the police arrived, she struggled as they escorted her but didnââ¬â¢t try to resist, preve nt or oppose her arrest as she only just struggled till they calmed her down.Under these circumstances, my client was misunderstood as she was in a different state of mind and doesnââ¬â¢t deserve the severity of these punishments including larceny under section 117 carrying a maximum sentence of five years imprisonment, common assault under section 61 carrying a maximum of sentence of two years imprisonment and resisting arrest, under section 58 carrying a maximum sentence of five years imprisonment.Section 32 1) b) reads the interest of the person having regard only to: Subsection iv) ââ¬Å"whether or not the person is, in the opinion of theà authorised officerà orà court, incapacitated by intoxication, injury or use of a drug or is otherwise in danger of physical injury or in need of physical protectionâ⬠Your honour, my client has an ongoing problem with alcohol leading to intoxication which may lead to making unsound judgements/decisions and for this reason may ne ed professional help or counselling regarding her alcohol problem as her addiction may get worse if it is not treated properly.Section 32 1) b1) subsection i) states the protection of ââ¬Å"any person against whom it is alleged that the offence concerned was committedâ⬠In regards to the protection of the security guard, my client has no intention to harm him or any intention to revisit that store as she is willing to move to Melbourne to live with her daughter.Section 32 1) c) subsection iv) reads ââ¬Å"the protection and welfare of the community, having regard only to whether or not it is likely that the person will commit any seriousà offenceà while at liberty onà bail, but theà authorised officerà orà courtà may have regard to this likelihoodâ⬠Your honour, my clientââ¬â¢s history of larceny may be an issue but to stop my client from reoffending, her daughter is willing to let my client live with her which will influence her to the good as she wonâ⠬â¢t put strain on the relationship she has with her only family.As this is an application for conditional bail, under bail conditions section 36 2) a) one or more of the following conditions only may be imposed on the grant ofà bail; that the accused personà enterà into an agreement to observe specified requirements as to his or her conduct while at liberty onà bail, other than financial requirements. Your honour, my client is willing to enter an agreement concerning residing at a specific premises and entering a rehabilitation program for her alcohol abuse which will prevent my client from panicking in certain situations causing her to cause harm to others.Section 36 2) a1) statesà that the accused person enter into an agreement to reside, while at liberty onà bail, in accommodation for persons onà bail. As mentioned before, my client has agreed to reside with her daughter at 12 Brown Road, Brownfield 3425 in Melbourne. Living with her daughter will influence my cl ient to obey the laws and prevent her from shoplifting which may have a positive impact on her life. This way, Mrs.Ayoubââ¬â¢s pension cheque wonââ¬â¢t be her only form of income as her daughter will provide for my client which will minimize the chances of my client wanting to shoplift. My client agrees to appear in court when needed and will sign in at an assigned police station if granted bail. Section 36 2) b) states ââ¬Å"that one orà more than oneà acceptable person (other than the accused person) acknowledge that he or she is acquainted with the accused person and that he or she regards the accused person as a responsible person who is likely to comply with his or herà bail undertaking. Your honour my clientââ¬â¢s daughter has acknowledged her mother as a responsible person as she wouldnââ¬â¢t be willing to let her stay if she wasnââ¬â¢t likely to comply with her bail conditions. To conclude my submissions, I would like your honour to take into considerat ion the misunderstanding of the three offences as my client expresses great remorse and is embarrassed that her intoxication led to this stage. If your honour has no further questions, that concludes my submission.
